BOWLING GREEN, Ohio — Aaron Fisher, who confessed
to the 2009 rape of his infant daughter in Miller County,
has been arrested in Bowling Green, Ohio.
An arrest warrant for Fisher was issued last week out of Miller County for assault, in connection with the 2009 incident. The Toledo Police Department confirmed Tuesday that Fisher was found by a Toledo PD task force in Bowling Green, on the evening of Nov. 21, 2016.
Fisher was never sentenced for the sodomy and abuse of his 6-month-old daughter, despite giving oral and written confessions—according to authorities—entering a guilty plea, and then—before changing the plea to guilty—actually showing up for trial.
His case was dismissed in late 2015 by Cole County Circuit Judge Patricia Joyce, after approximately six years of legal proceedings. Joyce ruled that Fisher’s constitutional right to a speedy trial had been violated. The prosecution argued the delays had largely been the fault of Fisher’s defense attorneys, some of whose continuance requests are recorded.
Joyce handled the case after both 26th circuit judges Kenneth Hayden and Stan Moore recused themselves from it.
Miller County Prosecutor Ben Winfrey could not be immediately reached for comment.
